vi. Nutzung von Produkten anderer Hersteller bzw. Nut-

zung in Kombination mit solchen Produkten, sofern der

Defekt/Fehler auf die Nutzung des Geräts zusammen

mit dem Gerät des anderen Herstellers zurückzufüh-

ren ist

vii. Andere Ursachen, die sich aus der nicht bestimmungs-

gemäßen Nutzung des Produkts ergeben

Unter den oben beschriebenen Bedingungen ist der Endbe-

nutzer nicht zur Nichtannahme oder Rückgabe des Produkts

oder zur Rückerstattung des Kaufpreises durch ZTE berechtigt.

• Diese Garantie stellt das einzige Rechtsmittel des Endbe-

nutzers sowie die einzige Haftung des Unternehmens für

beschädigte, fehlerhafte oder nicht den Vorschriften ent-

sprechende Geräte dar. Sie ersetzt alle übrigen ausdrückli-

chen, stillschweigenden oder gesetzlich vorgeschriebenen

Garantien, insbesondere die stillschweigende Garantie der

Marktfähigkeit und Eignung des Geräts für einen bestim-

mten Zweck, sofern nicht durch eine zwingende gesetzli-

che Bestimmung etwas anderes vorgeschrieben ist.

Einschränkung der Haftung

ZTE ist nicht haftbar für Gewinnausfälle, indirekte, spezielle,

beiläuge oder Folgeschäden, die durch oder im Zusammen-

hang mit der Nutzung des Produkts entstanden sind, unab-

hängig davon, ob ZTE auf die Möglichkeit solcher Schäden

hingewiesen wurde, davon wusste oder hätte wissen müssen.

Dies gilt insbesondere für entgangene Gewinne, Unterbre-

chung der Geschäftstätigkeit sowie für Investitionskosten,

Kosten für Ersatzbeschaffung sowie für durch Systemausfälle

entstandene Kosten.
