DIREITOS DE AUTOR
Todos os títulos e direitos de autor do e relacionados
com o SOFTWARE (incluindo, mas não
limitados a, dados de mapa, imagens, fotografias,
animação, vídeo, áudio, música, texto e aplicações
incorporados no SOFTWARE), e quaisquer cópias
do SOFTWARE, são propriedade da SONY,
licenciadores e fornecedores da SONY e respetivas
empresas afiliadas (tais licenciadores e fornecedores
da SONY, em conjunto com as respetivas empresas
afiliadas, são coletivamente denominados neste
documento “Licenciadores da SONY”). Todos os
direitos não especificamente concedidos ao abrigo
desta LICENÇA são reservados pela SONY ou
Licenciadores da SONY.
ATIVIDADES DE RISCO ELEVADO
O SOFTWARE não é tolerante a falhas e não foi
concebido, fabricado nem se destina a ser utilizado
em ambientes perigosos que requeiram um
desempenho isento de falhas, tais como a utilização
em instalações nucleares, navegação aérea ou sistemas
de comunicação, controlo de tráfego aéreo, máquinas
de suporte direto à vida ou sistemas de armas, nos
quais a falha do SOFTWARE possa provocar morte,
lesões pessoais ou graves danos físicos ou ambientais
(“Atividades de Risco Elevado”). A SONY, as suas
empresas afiliadas, os respetivos fornecedores e os
Licenciadores da SONY não oferecem qualquer
garantia explícita ou implícita de adequação para
Atividades de Risco Elevado.
EXCLUSÃO DA GARANTIA DO SOFTWARE
Reconhece e concorda expressamente que a
utilização do SOFTWARE é do seu inteiro risco.
O SOFTWARE é fornecido “TAL COMO ESTÁ” e
sem garantia de qualquer tipo, sendo que a SONY,
as suas empresas afiliadas, respetivos fornecedores
e os Licenciadores da SONY (nesta secção, SONY,
as suas empresas afiliadas, respetivos fornecedores
e os Licenciadores da SONY são coletivamente
denominados “SONY”) NÃO OFERECEM
QUAISQUER GARANTIAS E CONDIÇÕES,
EXPRESSAS OU IMPLÍCITAS, RESULTANTES
DE LEIS OU OUTRAS, INCLUINDO, MAS NÃO
LIMITADAS A, GARANTIAS E CONDIÇÕES
IMPLÍCITAS DE QUALIDADE, NÃO VIOLAÇÃO,
COMERCIALIZAÇÃO E ADEQUAÇÃO A UM
FIM ESPECÍFICO. A SONY NÃO GARANTE
QUE AS FUNÇÕES CONTIDAS NO SOFTWARE
IRÃO CUMPRIR OS SEUS REQUISITOS OU QUE
O FUNCIONAMENTO DO SOFTWARE SERÁ
ININTERRUPTO OU ISENTO DE ERROS. A
SONY NÃO GARANTE NEM FAZ QUAISQUER
REPRESENTAÇÕES RELATIVAMENTE À
UTILIZAÇÃO, INCAPACIDADE DE UTILIZAÇÃO
OU RESULTADOS DE UTILIZAÇÃO DO
SOFTWARE EM TERMOS DE EXATIDÃO,
PRECISÃO, FIABILIDADE OU OUTRO. ALGUMAS
JURISDIÇÕES NÃO PERMITEM A EXCLUSÃO
DE GARANTIAS IMPLÍCITAS. NESTE CASO, AS
EXCLUSÕES SUPRAMENCIONADAS PODERÃO
NÃO SE APLICAR A SI.
Compreende expressamente que os dados no
SOFTWARE poderão conter informações incorretas
ou incompletas devido à passagem do tempo,
circunstâncias de mudança, fontes utilizadas e recolha
avultada de dados geográficos, sendo que qualquer
uma destas poderá conduzir a resultados incorretos.
LIMITAÇÃO DE RESPONSABILIDADE
NESTA SECÇÃO, A SONY, AS SUAS EMPRESAS
AFILIADAS, OS RESPETIVOS FORNECEDORES
E OS LICENCIADORES DA SONY SERÃO
COLETIVAMENTE DENOMINADOS “SONY”
ATÉ AO LIMITE MÁXIMO PERMITIDO PELA
LEGISLAÇÃO APLICÁVEL. A SONY NÃO SERÁ
RESPONSÁVEL POR QUALQUER RECLAMAÇÃO,
PEDIDO OU AÇÃO, INDEPENDENTEMENTE

NUMA AÇÃO CONTRATUAL OU ATO
ILÍCITO COM BASE NA GARANTIA, MESMO
QUE A SONY TENHA SIDO AVISADA DA
POSSIBILIDADE DE TAIS DANOS, EXCETO
EM CASO DE NEGLIGÊNCIA GROSSEIRA OU
TRANSGRESSÃO DELIBERADA DA SONY,
MORTE OU LESÃO PESSOAL E DANOS DEVIDO
A NATUREZA DEFEITUOSA DO PRODUTO.
EM QUALQUER CASO, SALVO AS EXCEÇÕES
SUPRAMENCIONADAS, A RESPONSABILIDADE
TOTAL DA SONY AO ABRIGO DE QUALQUER
PROVISÃO DESTA LICENÇA SERÁ LIMITADA
AO TOTAL REAL PAGO ATRIBUÍVEL AO
SOFTWARE. ALGUMAS JURISDIÇÕES NÃO
PERMITEM A EXCLUSÃO OU LIMITAÇÃO DE
DANOS CONSEQUENCIAIS OU ACIDENTAIS.
NESTE CASO, AS EXCLUSÕES OU LIMITAÇÕES
SUPRAMENCIONADAS PODERÃO NÃO SE
