DEFEITO NO SOFTWARE, OU VIOLAÇÃO
DOS TERMOS OU DAS CONDIÇÕES, QUER
NUMA AÇÃO CONTRATUAL OU ATO
ILÍCITO COM BASE NA GARANTIA, MESMO
QUE A SONY TENHA SIDO AVISADA DA
POSSIBILIDADE DE TAIS DANOS, EXCETO
EM CASO DE NEGLIGÊNCIA GROSSEIRA OU
TRANSGRESSÃO DELIBERADA DA SONY,
MORTE OU LESÃO PESSOAL E DANOS DEVIDO
A NATUREZA DEFEITUOSA DO PRODUTO.
EM QUALQUER CASO, SALVO AS EXCEÇÕES
SUPRAMENCIONADAS, A RESPONSABILIDADE
TOTAL DA SONY AO ABRIGO DE QUALQUER
PROVISÃO DESTA LICENÇA SERÁ LIMITADA
AO TOTAL REAL PAGO ATRIBUÍVEL AO
SOFTWARE. ALGUMAS JURISDIÇÕES NÃO
PERMITEM A EXCLUSÃO OU LIMITAÇÃO DE
DANOS CONSEQUENCIAIS OU ACIDENTAIS.
NESTE CASO, AS EXCLUSÕES OU LIMITAÇÕES
SUPRAMENCIONADAS PODERÃO NÃO SE
APLICAR A SI.
PROIBIÇÃO DE EXPORTAÇÃO
RECONHECE QUE A UTILIZAÇÃO DO
SOFTWARE EM ALGUNS PAÍSES, REGIÕES,
ÁREAS OU INSTALAÇÕES, OU QUE A
EXPORTAÇÃO DE PRODUTOS DO PAÍS
ONDE TAIS PRODUTOS ESTÃO DESTINADOS
AO COMÉRCIO, PODERÁ SER LIMITADA
OU PROIBIDA. CONCORDA UTILIZAR O
SOFTWARE OU EXPORTAR OS PRODUTOS EM
CONFORMIDADE COM AS LEIS APLICÁVEIS,
DISPOSIÇÕES REGULAMENTARES, LEIS E
REGULAMENTOS DOS PAÍSES, REGIÕES, ÁREAS
E INSTALAÇÕES RELEVANTES.
DIVISIBILIDADE
Se qualquer parte desta LICENÇA for considerada
inválida ou inaplicável, as restantes partes
permanecerão válidas.
LEI REGENTE E JURISDIÇÃO
Esta LICENÇA será regida pelas leis do Japão desde
que não originem conflitos com disposições legais
ou a Convenção das Nações Unidas para Contratos
relativos a Compra e Venda Internacional de
Produtos, que é expressamente excluída. Qualquer
disputa resultante desta LICENÇA será entregue à
jurisdição exclusiva do Tribunal Distrital de Tóquio,
e as partes aceitam, pelo presente documento, a
jurisdição deste tribunal. AS PARTES RENUNCIAM,
PELO PRESENTE DOCUMENTO, AO DIREITO
DE JULGAMENTO POR JÚRI COM RESPEITO
A QUALQUER QUESTÃO RESULTANTE OU
RELACIONADA COM ESTA LICENÇA. ALGUMAS
JURISDIÇÕES NÃO PERMITEM A EXCLUSÃO DO
DIREITO DE JULGAMENTO POR JÚRI. NESTE
CASO, A EXCLUSÃO SUPRAMENCIONADA
PODERÁ NÃO SE APLICAR A SI.
CONTRATO INTEGRAL
Estes termos e condições constituem o contrato
integral entre a SONY e o utilizador relativamente
à matéria do mesmo e substituí na sua totalidade
qualquer e todos os contratos escritos ou orais
anteriormente existentes entre nós com respeito à
matéria do mesmo.
UTILIZADORES FINAIS GOVERNAMENTAIS
Se o SOFTWARE for adquirido pelo ou em nome
do governo dos Estados Unidos ou qualquer outra
entidade que procure ou aplique direitos idênticos
aos normalmente reivindicados pelo governo dos
Estados Unidos, tal SOFTWARE constitui um “item
comercial”, tal como definido na 48 C.F.R. (“FAR”)
2.101, é licenciado ao abrigo desta LICENÇA e tal
SOFTWARE entregue ou, de outro modo, fornecido
será identificado e marcado com o “Aviso de
Utilização” tal como estabelecido pela SONY e/ou as
suas empresas afiliadas e será tratado de acordo com
este aviso.
