Ablauf der oben genannten Garantiefrist von zwölf (12) Monaten
oder drei (3) Monaten nach Beginn des von Sagem Communication
geleisteten Supports.
Diese Gewährleistungserklärung hat keinerlei Einfluss auf Ihre
gesetzlichen Rechte entsprechend den Bestimmungen der
nationalen Gesetzgebung oder auf Ihre aus dem Kaufvertrag
hervorgehenden Ansprüche gegenüber dem Händler.
Bei Zweifelsfällen unterliegt das Mobiltelefon den
Gewährleistungsbestimmungen zu Folgeerscheinungen von
Fehlern oder verborgenen Defekten in Übereinstimmung mit
Artikel 1641 und nachfolgenden Artikeln des bürgerlichen
Gesetzbuches von Frankreich.

Während der Garantiezeit werden mangelhafte Telefone nach
alleiniger Wahl von Sagem Communication ersetzt oder kostenlos
repariert. Hierbei muss bestimmt worden sein, dass die Arbeit, die
für die Inanspruchnahme der Garantieleistung erforderlich ist, bei
einem autorisierten Kundendienst vorgenommen wird und dass die
Versandkosten (Transport und Versicherung) zur Rücksendung des
Telefons an die vom Sagem Communication-Kundendienst
angegebene Adresse (Telefonnummer ist auf dem Lieferschein
angegeben) vom Kunden getragen werden.
Gemäß den grundlegenden rechtlichen Bestimmungen übernimmt
Sagem Communication keine Haftung, weder ausdrücklich noch
konkludent, für Garantieleistungsansprüche, die in diesem Abschnitt
nicht ausdrücklich aufgeführt sind. Außerdem übernimmt Sagem
Communication keine Verantwortung für immaterielle und/oder
direkte Schäden (z. B. Schäden durch Auftrags- bzw.
Ertragseinbußen oder andere finanzielle oder kommerzielle
Verluste), ganz gleich, ob solche Schäden im Garantiefall auftreten
oder nicht.
