Verkoop- en licentieovereenkomst
van eindgebruiker
DIT DOCUMENT IS EEN JURIDISCHE OVEREENKOMST TUSSEN U ('KOPER')
EN MASIMO CORPORATION ('MASIMO') VOOR DE AANKOOP VAN DIT PRODUCT
('PRODUCT') EN EEN LICENTIE VOOR DE BIJGELEVERDE OF INGEBOUWDE
SOFTWARE ('SOFTWARE'). DE VOLGENDE VOORWAARDEN VORMEN DE
VOLLEDIGE OVEREENKOMST TUSSEN DE PARTIJEN MET BETREKKING
TOT UW AANKOOP VAN DIT PRODUCT, TENZIJ NADRUKKELIJK ANDERS
OVEREENGEKOMEN IN EEN APART CONTRACT VOOR DE AANKOOP VAN DIT
PRODUCT. ALS U NIET AKKOORD GAAT MET DE VOORWAARDEN VAN DEZE
OVEREENKOMST, DIENT U HET VOLLEDIGE PRODUCT MET ALLE TOEBEHOREN
IN DE OORSPRONKELIJKE VERPAKKINGEN, TEZAMEN MET UW AANKOOPBEWIJS,
AAN MASIMO TE RETOURNEREN VOOR VOLLEDIGE TERUGBETALING.
Garantie
Masimo biedt de oorspronkelijke koper voor de periode van één (1) jaar vanaf de
aankoopdatum de garantie dat: (i) elk nieuw product en de softwaremedia zoals deze
worden geleverd geen defecten vertonen wat betreft uitvoering of materialen, en
(ii) het product en de software in ieder geval zullen werken zoals beschreven in de
gebruiksaanwijzing. De enige verplichting van Masimo onder deze garantie is de reparatie
of vervanging van een product dat of software die door deze garantie wordt gedekt.
Voor de batterij geldt een garantieperiode van zes (6) maanden.
Om een product te vervangen tijdens de garantieperiode, dient de koper contact op
te nemen met Masimo voor een machtiging tot terugzending. Indien Masimo vaststelt
dat het product tijdens de garantieperiode moet worden vervangen, wordt het apparaat
vervangen en worden de verzendkosten vergoed. De koper is verantwoordelijk voor alle
andere verzendkosten.
Uitsluitingen
De garantie geldt niet voor, en Masimo is niet verantwoordelijk voor, reparatie,
vervanging of vereist onderhoud als gevolg van: a) wijziging van het product of de
software zonder schriftelijke toestemming van Masimo; b) externe voorzieningen,
apparaten of elektrische werken of zulks dat niet door Masimo is gefabriceerd; c) het
demonteren of opnieuw in elkaar zetten van het product door iemand anders dan een
erkend Masimo-vertegenwoordiger; d) gebruik van het product met sensoren of andere
accessoires die niet door Masimo zijn gefabriceerd en gedistribueerd; e) gebruik van
het product en de software op manieren of in omgevingen anders dan die waarvoor ze
zijn bedoeld; en f) verwaarlozing, misbruik, onjuiste bediening, ongevallen, vuur, water,
vandalisme, het weer, oorlogen of overmacht. Deze garantie geldt niet voor producten
die worden hergebruikt of gerecycled.
Deze garantie is ook niet van toepassing op producten die aan de koper zijn verstrekt
voor test- of demonstratiedoeleinden, tijdelijke productmodules of producten waarvoor
de verkoper op geen enkele andere wijze een gebruiks- of aankoopvergoeding
ontvangt; dergelijke producten worden geleverd 'as-is' zonder garantie.
