b.Device Functionality.Allorcertainportionsofthedevicesoftwaremaybeinoperableifyoudo

c.Windows Phone Update.TheWindowsPhoneUpdate(“WPU”)featureofyourdeviceis

designedtoperiodicallycheckforupdatestothesoftwareonyourdeviceandtonotifyyouwhen

updatesareavailable.Duringinstallationofupdates,youmaynotbeabletouseyourdeviceor

deviceservices.Incertaincases,installationofanupdatemayberequiredbeforeyouareableto

useallorcertainfeaturesofthedeviceordeviceservices.Softwareupdatesavailablethroughthe

WPUfeaturewillbegovernedbytheselicenseterms.Iftheupdateisaccompaniedbynewlicense

terms,thenthosetermsapply.

YoumayonlyobtainupdatestothesoftwarefromMicrosoftorauthorizedsources.

Exceptasmaybeotherwisenotedinthetermsaccompanyinganupdateorsupplement,ifyou

obtainupdatesorsupplementstotheMicrosoftsoftwaredirectlyfromMicrosoft,Microsoftlicenses

thosetoyouasdescribedinthesetermsandtheWindowsPhoneTermsofUse.

d.Services.Exceptasotherwisespecifiedintheseterms,youruseofanyservicesonthedevice

maybesubjecttotermsofuseortermsofservicethatmayaccompanytheservicesanddata

chargesmayapply.

3.SCOPEOFLICENSE.

Thesoftwareislicensed,notsold.Thesetermsonlygivesyousomerightstousethesoftware.

CompanyandMicrosoftreserveallotherrights.Unlessapplicablelawgivesyoumorerights,you

mayusethesoftwareonlyasexpresslypermittedintheseterms.Indoingso,youmustcomplywith

anytechnicallimitationsinthesoftwarethatallowyoutouseitonlyincertainways.Youmaynot:

n workaroundanytechnicallimitationsinthesoftware;

n reverseengineer,decompileordisassemblethesoftware;

n makemorecopiesofthesoftwarethanspecifiedintheseterms;

n publishthesoftwareforotherstocopy;

n usethesoftwareforcommercialsoftwarehostingservices.

4.CONSENTTOINFORMATIONCOLLECTION.

MicrosoftprovidesInternet-basedserviceswiththesoftware.Theseservicesmaybechangedor

cancelledatanytime.CertainfeaturesofthesoftwareandservicesconnecttoMicrosoftorservice

providercomputersystemsovertheInternet.Insomecases,youwillnotreceiveaseparatenotice

whentheyconnect.Insomecases,youmayswitchoffthesefeaturesornotusethem.Microsoft

usescertaininformationcollectedfromyoutooperateandprovidetheservices.Additionally,aspart

oftheservices,Microsoftmayalsoautomaticallyuploadinformationaboutyourdevice,youruseof
