Artikel 5 Aansprakelijkheid

5.1 Giant sluit alle aansprakelijkheid uit voor schade aan (onderdelen van) de fiets die ontstaat ten gevolge van het onjuist

afstellen van de bewegende delen van de fiets, en het onjuist gebruiken en/of onderhouden van de fiets (waaronder

begrepen het niet tijdig vervangen van onderdelen als genoemd in artikel 3.1).

5.2 Indien Giant een vordering onder de garantie erkent, dan impliceert dit geenszins een erkenning van enige

aansprakelijkheid voor eventuele schade. Indien en voor zover er sprake is van geleden (gevolg)schade, sluit Giant

iedere aansprakelijkheid hiervoor uit voor zover zij niet wettelijk gebonden is aan vergoeding van deze schade.

5.3 De in het garantieplan van Giant aangeboden garantie vormt een aanvulling op de wettelijke rechten. Deze rechten

kunnen in elk land binnen de Europese Economische Ruimte verschillen.
