Die in Artikel 1 und 2 genannte Garantie gilt nicht:
a. wenn der Boiler durch externe Ursachen beschädigt wurde;
b. bei unsachgemäßem Gebrauch, Vernachlässigung (einschließlich
Einfrieren), Modikation, unsachgemäßer und/oder abweichend
Nutzung des Boilers, oder wenn versucht wurde, Lecks zu
reparieren;
c. wenn Verunreinigungen oder andere Partikel in den Wasserbehälter
strömen konnten;
d. wenn die Leitfähigkeit des Wassers 125 µS/cm und/oder die
Wasserhärte (Erdalkali-Ionen) 1,00 mmol/l unterschreitet;
e. wenn ungeltertes, rezirkuliertes Wasser durch den Boiler strömt
oder im Boiler gelagert wird;
f. wenn selbst versucht wurde, einen defekten Boiler zu reparieren.
Die von A.O. Smith kraft der Garantie übernommenen Verpichtungen sind auf
die kostenlose Lieferung der auszutauschenden Elemente oder Einzelteile bzw.
des Boilers ab Lager beschränkt. Transport-, Arbeits-, Installations- und andere
mit dem Austausch in Verbindung stehende Kosten entfallen nicht auf A.O. Smith.
Ein Schadensersatzanspruch, der auf der gewährten Garantie basiert, muss bei
dem Händler, bei dem der Boiler erworben wurde, oder bei einem anderen
Händler, der Produkte von A.O. Smith Water Products Company vertreibt, geltend
gemacht werden. Die in Artikel 1 und 2 genannte Prüfung des Boilers erfolgt in
einem Labor von A.O. Smith.
Bezüglich ihrer Boiler bzw. der als Ersatz gelieferten Boiler (oder Elemente oder
Einzelteile dieser Boiler) übernimmt A.O. Smith keine weiteren Garantien oder
Gewährleistungen als die in diesem Zertikat ausdrücklich genannten.
A.O. Smith haftet kraft der gewährten Garantie oder auch anderweitig nicht für
Personen- oder Sachschäden, die durch einen von ihr (als Ersatz) gelieferten
Boiler (oder Elemente oder Einzelteile bzw. den emaillierten Stahlbehälter dieses
Boilers) entstehen.
